Terms of Service
Short version: Charted is an iOS app sold through the Apple App Store. By installing and using it, you agree to the terms below. They are mostly the standard things you'd expect from a small, independent app.
I. The agreement
These terms form a binding agreement between you and Charted (“we”, “us”, the developer of the app). They govern your use of the Charted iOS application and this website. If you do not agree to them, please do not install or use the app.
II. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Charted on Apple devices you own or control, as permitted by the Apple App Store Terms of Service and the End-User Licence Agreement that ships with iOS. You may not redistribute, decompile, reverse-engineer, or resell the app, except where such restrictions are prohibited by applicable law.
III. Charted Plus
Charted offers an optional premium tier called Charted Plus, sold as a single one-time, non-consumable purchase. There are no subscriptions and no recurring charges. The purchase is billed by Apple through your Apple Account; we never see your payment details. Once unlocked, Charted Plus features are available to you on any Apple device signed in to the same Apple Account, for as long as the app remains available.
Restoring purchases
If you reinstall the app or set up a new device, use Restore Purchase inside the app to re-validate your entitlement through your Apple Account.
Refunds
Refund requests for App Store purchases are handled by Apple. You can request a refund at reportaproblem.apple.com. We do not have the ability to issue refunds directly.
IV. Your content
Anything you create inside Charted — charts, place names, notes, photos — remains yours. The app stores this data on your device and (if you have iCloud enabled) in your private iCloud container. We do not claim any rights to your content and we do not have access to it. See the Privacy Policy for details.
V. Acceptable use
You agree not to use Charted to:
- Violate any applicable law or regulation;
- Infringe anyone else's rights, including intellectual property and privacy rights;
- Attempt to interfere with the operation or security of the app, the App Store, or any iCloud infrastructure;
- Reverse-engineer the app for the purpose of redistribution.
VI. Map data & third parties
Charted uses Apple MapKit for maps and place search. Map content and place information are provided by Apple and its data partners; we do not control its accuracy. Use of those features is also subject to Apple's terms.
VII. Disclaimers
Charted is provided “as is”, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do our best to keep the app reliable and to back its data through your iCloud account, but we cannot guarantee it will be uninterrupted, error-free, or that no data will ever be lost.
VIII. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to your use of Charted is limited to the amount you paid for the app and any Charted Plus purchase in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to lost data, lost profits, or lost goodwill.
IX. Changes to these terms
We may update these terms from time to time. If a change is material, we will note the new effective date at the top of this page and surface the update in-app where reasonable. Continuing to use Charted after a change constitutes acceptance of the revised terms.
X. Governing law
These terms are governed by the laws of the United States and the state in which the developer resides, without regard to conflict-of-laws principles. Any disputes will be brought in the courts of competent jurisdiction in that state.
